EU Transparency & AI Compliance Policy

At SmartCallPro, we believe that transparency is not just a legal requirement — it is the foundation of trust. This page explains how we use artificial intelligence in our services, what that means for anyone who calls a business powered by SmartCallPro, and how we meet our obligations under EU law.

1. Who We Are

SmartCallPro is a technology services company providing AI-powered virtual call assistant services to businesses across the Czech Republic and the European Union.

We help businesses answer every call, capture every lead, and serve every customer — 24 hours a day, 7 days a week — through our Smart Call Assistant service.

2. Our Legal Basis for This Policy

This policy is published in accordance with:

  • Regulation (EU) 2024/1689 — the EU Artificial Intelligence Act ("EU AI Act"), Article 50 (Transparency obligations for providers and deployers of certain AI systems)
  • Regulation (EU) 2016/679 — the General Data Protection Regulation ("GDPR")
  • Applicable Czech national legislation implementing the above regulations

Full enforcement of Article 50 transparency obligations applies from 2 August 2026. SmartCallPro has implemented these obligations in advance of that date and considers full compliance to be a baseline requirement, not an option.

3. What AI We Use and Why

SmartCallPro deploys an AI-powered voice system called the Smart Call Assistant on behalf of our business clients.

The Smart Call Assistant:

  • Answers inbound telephone calls to our clients' businesses
  • Introduces itself by name at the start of every call
  • Clearly identifies itself as an automated call assistant
  • Captures caller information and enquiry details
  • Routes calls and sends notifications to the relevant business
  • Operates in Czech and English

The Smart Call Assistant is not a human being. It is an automated artificial intelligence system. Every caller is told this at the very start of every call, without exception.

4. What You Will Hear When You Call

If you call a business that uses SmartCallPro, you will hear the following type of disclosure at the start of your call:

In English

"Hello, thank you for calling [Company Name]. My name is [AI Assistant's Name], I am an automated call assistant. How can I help you?"

In Czech

"Dobrý den, děkujeme za váš hovor společnosti [Název firmy]. Jmenuji se [Jméno AI operátora], jsem automatizovaný hlasový asistent. Jak vám mohu pomoci?"

The disclosure is delivered in the language of your interaction. You will always know you are speaking with an automated system before the conversation continues.

This disclosure is mandatory and permanent. It cannot be switched off, removed, or altered by any business using our services. Any business that attempted to instruct us to do so would be in breach of their contract with us and in violation of EU law.

5. How We Classify Our AI System

Under the EU AI Act, AI systems are classified by the level of risk they present. The Smart Call Assistant is classified as a Limited Risk AI system under Article 50 of the EU AI Act.

This means it is subject to transparency obligations — specifically, the requirement to inform people when they are interacting with an AI system. SmartCallPro implements these obligations fully and proactively.

The Smart Call Assistant is not used for:

  • Biometric identification or categorisation
  • Emotion recognition
  • Real-time surveillance
  • Any purpose classified as High Risk under Annex III of the EU AI Act

6. Our Commitments Under the EU AI Act

We disclose AI use on every call. Every caller is informed at the start of every interaction that they are speaking with an automated call assistant. No exceptions. No opt-outs for clients.

We name our AI assistants. Each Smart Call Assistant is assigned a name. That name is disclosed to callers at the start of every call so the interaction feels clear, professional, and honest.

We maintain technical documentation. SmartCallPro maintains documentation of the Smart Call Assistant's capabilities, limitations, and intended purpose in accordance with EU AI Act requirements. This documentation is available to competent regulatory authorities upon lawful request.

We keep our clients accountable. Every business using SmartCallPro is contractually required to use our services in compliance with the EU AI Act. They may not instruct us to hide, suppress, or misrepresent the automated nature of our service.

We cooperate with regulators. Smart Call Pro will cooperate fully with the European AI Office, national competent authorities, and any lawful regulatory inquiry relating to our AI systems.

We stay current. EU AI Act guidance continues to develop. SmartCallPro monitors all relevant regulatory updates, European Commission guidance, and national authority decisions, and updates our practices accordingly.

7. Your Data and Your Rights

When you interact with a Smart Call Assistant, your call may be transcribed and summarised. This information is shared with the business you called so they can follow up with you appropriately.

How long is your data kept? Call data and transcripts are retained for a maximum of 90 days and then permanently deleted, unless a shorter retention period has been agreed with the client business.

Who controls your data? The business you called is the Data Controller responsible for your personal data. Smart Call Pro acts as a Data Processor on their behalf, processing your data only for the purpose of delivering the call handling service.

Your rights under GDPR include:

  • The right to access personal data held about you
  • The right to correct inaccurate personal data
  • The right to request deletion of your personal data
  • The right to restrict or object to processing
  • The right to lodge a complaint with a supervisory authority

To exercise your rights: Contact the business you called directly, as they are responsible for your data. If you are unable to reach them or require assistance, you may contact SmartCallPro at compliance@smartcallpro.cz and we will direct your request to the appropriate party.

9. Policy Updates

This policy will be reviewed and updated as required, including in response to:

  • New or updated EU AI Act guidance and enforcement decisions
  • Changes to GDPR implementation or national data protection law
  • Updates to our AI systems or service delivery model
  • Full enforcement of Article 50 obligations from 2 August 2026

The version number and effective date at the top of this page will reflect any updates. We recommend checking this page periodically.
